Terms and Conditions

1. Introduction

Welcome to Afripace (“we,” “us,” or “our”), the digital learning and freelancing platform accessible at afripace.com. These Terms of Service (“Terms”) govern your use of our courses, freelancing marketplace, affiliate program, and community features (collectively, the “Service”). By accessing the Service, you agree to these Terms and our Privacy Policy. If you disagree, do not use the Service.

 


2. Definitions

  • Student: User enrolling in courses.

  • Instructor: User creating/publishing courses.

  • Freelancer: User offering services (e.g., design, coding) via the marketplace.

  • Client: User purchasing freelancing services.

  • Affiliate: User promoting Afripace for commissions.

  • Content: Text, videos, code, designs, or materials uploaded to the Service.

  • Service: Includes afripace.com, mobile apps, WhatsApp/Telegram groups or channels, forums, and related services.

 


3. Account Registration

  • Accuracy: Provide truthful, up-to-date information during signup.

  • Age Restriction: Users must be 16+. Under-16s require verifiable parental consent.

  • Security: Notify us immediately at support@afripace.com for unauthorized access.

  • Termination: We may suspend accounts for fraud, hate speech, community abuse, or breaches of policy.

 


4. Purchases & Payments

A. Payment Methods
  • Accepted Methods: Credit/debit cards, mobile money (MTN Mobile Money, Airtel Money, etc), Flutterwave, Paystack.

  • Third-Party Processors: PCI-DSS compliant; we do not store card numbers.

 

B. Refunds
  • Courses: Full refund within 7 days if less than 25% of course content is accessed.

  • Freelancing Services: Refund eligibility determined case-by-case via escrow mediation.

 

C. Payouts
  • Instructors: Paid after 7-day refund period ends. Minimum balance: 50 GHS.

  • Affiliates: Paid monthly. Minimum balance: 10 GHS.

  • Freelancers: Released 24 hours after client approval (minus 10% platform fee).

 


5. Subscriptions & Free Trials

  • Renewals: Auto-renew unless canceled 48 hours before the billing cycle.

  • Free Trials: Require a valid payment method. No charges until the trial ends.

  • Fee Changes: 14-day notice for subscription adjustments.

 


6. Role-Specific Terms

A. Students
  • Course Access: Personal use only. No resale or redistribution.

  • Certifications: Issued upon completion; verify authenticity via Afripace’s Certificate Verification page.

  • Community Conduct: Respectful interaction is required in Afripace forums, chats, and WhatsApp/Telegram groups. Hate speech, spamming, or off-topic posting may result in removal.

 

B. Instructors
  • Content Ownership: Retain rights but grant Afripace a non-exclusive, global license to host, market, and sell your courses.

  • Quality Standards: Courses must be original, non-infringing, and updated quarterly.

  • Course Removal: Courses cannot be permanently deleted after publishing but may be unpublished or hidden for violations, poor ratings or at instructor’s request.

  • Payouts: 50% of course revenue (minus fees) via mobile money/bank transfer.

 

C. Freelancers
  • Profile Accuracy: Skills, experience, and pricing must be truthful.

  • Project Delivery: Complete work as agreed with clients. Fake reviews or plagiarism may result in termination.

 

D. Clients
  • Escrow Payments: Funds held securely until project completion.

  • Disputes: Raise within 5 days of delivery. Afripace may mediate but is not liable for final outcomes.

 

E. Affiliates
  • Commissions: 40% per referral (students).

  • Promotional Rules: No spam, trademark misuse, or false advertising. Violation may result in forfeiture of commissions.

 


7. Content & Intellectual Property

  • User Content: You retain ownership but grant Afripace a license to use it for platform operations and marketing.

  • Platform Ownership: Afripace owns the software, branding, layout, and platform designs.

  • DMCA: Report infringement to legal@afripace.com.

 


8. Prohibited Conduct

  • All Users: No hacking, hate speech, harassment, illegal activity, or exploitation.

  • Instructors/Freelancers: No plagiarism, fake reviews, or substandard work.

  • Affiliates: No fraudulent promotions, impersonation, or trademark abuse.

 


9. Termination

  • By Afripace: Immediate suspension for fraud, breaches, or illegal activity.

  • By You: Delete your account via settings or contact support.

  • Survival Clauses: IP rights, payment obligations, and dispute terms remain post-termination.

 


10. Legal & Compliance

  • Governing Law: Disputes governed by Ghanaian law, with jurisdiction in Accra courts.

  • Regional Compliance: Adheres to Ghana’s Data Protection Act, Nigeria’s NITDA, Kenya’s Data Protection Act, and South Africa’s POPIA.

  • Limitation of Liability: Afripace is not liable for indirect, incidental, or consequential damages (e.g., loss of profits).

  • Force Majeure: Afripace is not liable for failure to perform due to events beyond its control (e.g., natural disasters, platform outages, war).

 


11. Dispute Resolution

  1. Negotiation: Attempt resolution via support@afripace.com

  2. Mediation: Unresolved disputes escalate to mediation in Accra, Ghana.

  3. Class Action Waiver: Claims must be filed individually.

 


12. Updates & Contact

  • Changes: We may update these terms of service from time to time. If we make significant changes, we will notify you by email, website banner, or in-app notice. Continued use of the Service after updates constitutes your acceptance.
